One and a half years have past since the draft Council of Europe Convention on Transfrontier Audiovisual Media Services, aimed at aligning the existing Council of Europe convention with the AVMS-Directive, was submitted. To this date, no text has been presented for ratification to the Member States of the Council of Europe, as the following questions remain unanswered: Do Member States still have the competence to ratify European conventions or is it for the European Union to undertake harmonisation with the AVMSDirective? The European Commission has hitherto held firmly to the view that due to the harmonisation through the AVMS-Directive the conclusion of new conventions cannot be made by the Member States anymore. Should fundamental changes be made to the content of the convention? In Germany it is considered that in future only basic principles of transfrontier audiovisual media services should be laid down. We invite you to a discussion on those questions and possible solutions.
