Comparing U.S. and German Approaches

Historically, different societies have accorded differing levels of protection to the fundamental right to reputation and the interest in free speech. Whereas the German Basic Law provides explicit protections for reputation, the United States cuts the balance more decisively in favour of free speech. This symposium will examine how four different countries (Germany, the United States, Australia and the United Kingdom) balance reputation and speech interests (with a lesser emphasis on France).
